1. General

1.1 These are the Draftstars Website Terms and Conditions of Use (Terms) of Draftstars Pty Limited (ACN 609 405 816) (Draftstars, Our, We, Us). Draftstars is licensed as a sports bookmaker in the Northern Territory (‘NT’), Australia by the NT Racing Commission (‘NTRC’) to accept bets and wagers (together bets) by electronic transmission, twenty-four (24) hours per day.

1.2 The Website means www.Draftstars.com.au. The Website is owned and operated by Us.

1.3 “You” and “Your” means the person using, browsing or otherwise accessing any content or data on the Website, including any subdomains of the Website, or related top-level domains including www.Draftstars.com.au, mobile sites, Apps, APIs and widgets (together, Our Websites).

1.4 You acknowledge and agree that by using, browsing or otherwise accessing Our Websites, You agree to be bound by these terms and conditions of use (Terms), and our Privacy Policy. You agree to ensure that any person who accesses Our Websites on Your behalf abides by these Terms. You acknowledge that We provide use and access to Our Websites to You subject to these Terms.

1.5 We reserve the right to change any of the Terms or other conditions for using Our Websites at any time by publishing new terms or conditions on the Website. Your use of Our Websites constitutes Your acceptance of those terms and conditions. Should You object to any of Our terms and conditions of use or other notices on Our Websites Your sole option is to immediately cease Your use of Our Websites.

1.6 You also acknowledge and agree that by using Our Websites, You agree to be bound by the terms and conditions of Our General Rules and any other terms and conditions published on the Website from time to time.

1.7 Your use of information on our site including results, fixture lists, statistics, data (including team or player data), live or historical scores and any other figures posted on Our Website is at Your own risk. Other than as expressly set out in these Terms and to the extent permitted by law, We make no warranty as to the accuracy or reliability of the information contained on Our Websites or in Our publications (including, but not limited to, any content or information generated on Our Websites by or on behalf of Us, and any Third Party Content on Our Websites). We and Our related entities, directors, officers and agents disclaim all liability and responsibility for any direct or indirect loss or damage which may be suffered by any recipient through relying on anything contained in or omitted from Our Websites or publications.

2. User Registration

2.1 If You wish to become a registered user of Our Websites (Member), You will need a user account (Account). In order to apply for an Account, You must complete all details in accordance with the instructions on the Website or We may complete those in certain circumstances.

2.2 Upon grant of the Account by Us, your Account will be open and You will be able to use Our Websites with Us. We may refuse to grant an application for an Account made by any person without giving a reason for such refusal.

2.3 You continuously represent and warrant to Us that persons accessing Your Account are authorised to do so.

2.4 You are not authorised to bet on Our Websites or otherwise until we have opened Your Account.

2.5 We may require You to change Your username at Our discretion.

3. Security

Access to Your Account and to add to, delete or modify content on Your Account is password protected. You must memorise Your password or store Your password in a safe and secure place. You agree that You will not disclose Your password to anyone or allow any other person to access or use Your Account.

4. Restrictions on use of Our Websites

4.1 In accessing or using Our Websites you agree that you will not:

(a) Use any automated device, software, process, scripting or means to access, retrieve, scrape, or index Our Websites or any content on Our Websites without Our express prior written consent;

(b)  Use any automated device, software, process or scripting to place any bets on Our Websites.

(c) Use any device, software, process or means to interfere or attempt to interfere with the proper working of Our Websites;

(d)  Undertake any action that will impose a burden or make excessive traffic demands on Our infrastructure that we deem, in Our sole discretion to be unreasonable or disproportionate site usage;

(e)  Use or index any content or data on Our Websites for purposes of competing with Us in any manner that we have not specifically authorised;

(f)  Transmit spam, chain letters, Wagering Contests, junk email, surveys, or other mass messaging, whether commercial in nature or not;

(g) Use Our Websites or any content from Our Websites in any manner which is, in Our sole discretion, not reasonable and / or not for the purpose it is made available;

(h)  Violate the rights of any person, including copyright, trade secret, privacy right, or any other intellectual property or proprietary right;

(i) Pose as any person or entity or attempt to solicit money, passwords or personal information from any person;

(j)  Act in violation of any Term or condition of use of Our Websites including General Rules, Bonus Bet Rules or any other terms and conditions posed by Us or any applicable law;

(k) Reproduce, republish, retransmit, modify, adapt, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit Our Websites or any content on Our Websites, except as expressly authorised by us; or

(l) Transmit or attempt to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature.

4.2 We reserve the right to exercise whatever means we deem necessary to prevent unauthorised access to or use of Our Websites, including, but not limited to, instituting technological barriers, or reporting your conduct to any person,entity, or governmental agency or authority.

5. Intellectual Property

5.1 Unless indicated otherwise, as between Us and You, we are the owner and/or licensee of all intellectual property in, and the material we publish on, Our Websites. Subject to these Terms, You agree that You will not infringe Our intellectual property as contained in Our Websites.

5.2 Except to the extent required for your personal and non-commercial use of our Websites and subject to these Terms, you must not modify, copy, republish, frame, distribute, sell, transmit or interfere with any part of or information on Our Websites without our consent.

6. Use of Information

6.1 You agree that content You provide to Us in the course of accessing or using Our Websites, will be available to Us to use in any manner We think fit subject to applicable provisions of any legislation including, without limitation, privacy legislation.

6.2 You agree, and continuously represent and warrant each time You access Your Account and Our Websites that You will not upload or otherwise provide any content which:

(a) Is inaccurate, misleading, deceptive, incomplete, defamatory, fraudulent, unlawful, tortious or confidential;

(b)  Infringes the intellectual or other proprietary interests of third parties;

(c) Contains spam, computer viruses, computer code, files or programs or other harmful components that are designed to interrupt, destroy, change or limit the functionality of Our Websites or any other computer software, hardware or other electronic equipment, information which in any way impinges on another user’s use or enjoyment of Our Websites or otherwise breaches or encourages other users to breach these Terms;

(d)  Violates any law, statute or regulation; and/or

(e)  Forges information to disguise the origin of any Content.

7. Third Party Content

Our Websites contain content provided to Us by other parties (Third Party Content). This includes information relating to sports, team and player data, other statistics and betting information. We are not responsible for, do not endorse and make no representations either expressly or impliedly concerning Third Party Content. Third Party Content does not represent Our views. You rely on Third Party Content completely at Your own risk.

8. Privacy

8.1 You agree to comply with Our Privacy Policy, together with any guidelines and statements as may be applicable from time to time, including those incorporated into these Terms.

9. Limitation of Liability

9.1 You agree that, to the maximum extent permitted by law, neither We nor Our directors, officers, employees, contractors, or agents are liable to You or anyone else for any loss or damage (including, without limitation, any direct, indirect, special or consequential loss) arising as a result of breach of these Terms, in tort (including negligence) or otherwise arising out of, or in connection, with:

(a) The use of Our Websites;

(b)  Any Content You upload or otherwise provide;

(c) The use by Us of information provided by You to Us through Our Websites;

(d)  Being unable to access Our Websites for whatever reason and however arising, including (without limitation) negligence;

(e)  The failure of Our Websites for whatever reason and however arising including (without limitation) negligence; and/or

(f)  The use of Your password by You or any third party to whom You have made the password available.

9.2 We expressly limit, and You agree, Our liability for breach of a condition or warranty implied or a consumer guarantee imposed by virtue of any legislation to the supply of the services again or the payment of the cost of having the services supplied again (the choice of which is to be at Our sole discretion).

9.3 You indemnify Us against any action, liability, claim, loss, damage, proceeding, expense (including legal costs) suffered or incurred by Us, arising from, or which is directly or indirectly, related to:

(a) Your breach or non-observance of any of these Terms;

(b)  Any Content You upload or otherwise provide;

(c) Any breach or inaccuracy in any representations or warranties made to Us; and/or

(d)  Any breach, or alleged breach, of intellectual or other proprietary rights or interests of third parties.

10. Choice of Law

These Terms, and the agreement of which they form part, are governed by the laws of the Northern Territory of Australia.

11. Disclaimer

11.1 Except as provided by law, Our Websites are provided “as is” and without any warranty or condition, express or implied.

11.2 We do not warrant that the information contained in or accessible through Our Websites is accurate, suitable for Your purposes or without errors, omissions or viruses. We do not guarantee continuous, uninterrupted or secure access to Our Websites. You acknowledge that access and Use of Our Websites (including the software operating in connection with Our Websites) may be interfered with by numerous factors outside of Our control. We do not warrant the accuracy of any advice, opinion, statement, representation or other information displayed on or accessible through Our Websites.

General Terms & Conditions

1. General

1.1 These are the General Rules of Draftstars Pty Ltd (ACN 609 405 816) (Draftstars, We, Us), a company incorporated in Australia under the Corporations Act 2001 (Cth). Draftstars is licensed as a sports bookmaker in the Northern Territory (‘NT’), Australia by the NT Racing Commission (‘NTRC’) to accept bets and wagers (together ‘bets’) by electronic transmission, twenty-four (24) hours per day.

1.2 These General Rules shall be read in conjunction with the Draftstars Website Terms and Conditions located at www.Draftstars.com.au or via our mobile phone or tablet applications (together ‘the Website’), which applies to all Draftstars Users. You and Your means a User using, browsing or otherwise accessing any content or data on the Website to enter a Wagering Contest. You acknowledge and agree that, by opening an Account (as defined in the Website Terms and Conditions of use and/or placing bets, You agree to be bound by these General Rules.

1.3 We reserve the right to change, amend or add to these General Rules at our discretion, and will publish such changes on our Website. You agree that any changes, amendments or additions published on our Website will be taken to be effective immediately. It is Your responsibility to ensure that You are aware of the current General Rules.

1.4 Where a customer has successfully opened a duplicate Account with Draftstars (i.e. where one Account already exists in any state), Draftstars will attempt to ensure restrictions are applied to the new Account. Any duplicate accounts registered are in breach of Draftstars’ Rules, customers accept that this is on a “best effort” basis and that they are still responsible for transactions on all accounts registered using their details. If a duplicate account is identified, the account will be closed immediately.

1.5 Subject to these Terms and Conditions, Draftstars accepts all wagers placed by Users via the Website in its capacity as a bookmaker.  Draftstars accepts all liability of paying out winnings to the User if that wager is successful. If a User’s wager is unsuccessful, the funds used to place that wager will be retained by Draftstars.

1.6 Draftstars has the authority to cancel bets, which include Bonus Bets, regardless of if the bet has been settled or is still pending.

2. Definitions

2.1 For the purpose of the Website, the following definitions apply:

(a) Athletes means the real life athletes which can be selected in a Lineup by Players.

(b)  Attributes means the characteristics of a Wagering Contest, including Tournament Type, Entry Fee, Rake, Max Number of Previous Wagering Contests and any restrictions.

(c) Entry means the Lineup submitted by a Player into a Wagering Contest and the placement of a bet by a Player allowing participation in a Wagering Contest.

(d)  Entry Fee means the bet amount required to enter into a Wagering Contest.

(e)  Entry Limit means the maximum number of Players who can enter a Wagering Contest.

(f)  Lineup means the Athletes selected by a Player for Entry into a Wagering Contest.

(g) Lobby means the part of the Website which includes a list of all upcoming Wagering Contests.

(h)  Matches means the real life matches in a Sport from which Players can select Athletes for their Lineup.

(i) Payout means the winnings a Player can receive from placing a successful bet on a Wagering Contest (in some cases referred to as “winnings”).

(j)  Payout Breakdown means the breakdown of the Prize Pool available to be won by Players in a Wagering Contest.

(k) Player means the individual using the website to enter a Wagering Contest (also referred to as You or the User).

(l) Points means the points Athletes can score which contribute to a Player’s score.

(m)  Position Requirements means the positions of the Athletes a Player required to complete a valid Lineup (for example in NBA, 2 x point guards, 2 x shooting guards, 2 x forwards, 2 x centres and 1 x utility).

(n)  Prize Pool means the total value of the Payouts available to Players in a Wagering Contest.

(o)  Rake means the portion of the total Entry Fees held by Draftstars for a Wagering Contest.

(p)  Rounds means the round of matches for a Sport from which Matches can be selected for a Slate.

(q)  Salaried Roster means the maximum total value of all Salaries of the Athletes in a Lineup.

(r)  Salary means the salary value attributed to an Athlete.

(s) Scoring System means the key for how Athletes earn Points in a Wagering Contest and can be found in the Wagering Contest Rules and FAQs.

(t)  Slate means the group of Matches included in a Wagering Contest.

(u)  Sport means the sports league relevant to a Wagering Contest. For example, AFL, NRL and NBA.

(v) Team means the teams in a Sport from which Players can select Athletes.

(w) Total Stake means the total value of Entry Fees into a Wagering Contest.

(x) Tournament Type means the style of tournament (for example Salary or Turbo).

(y) Wagering Contest means the event in which Players compete against each other by submitting Lineups of Athletes which score Points in accordance with the Wagering Contest Rules.

(z) Wagering Contest Name means the name of the Wagering Contest.

(aa) Wagering Contest Rules means the relevant rules and details according to which a Wagering Contest will be run including the Sport, Prize Pool, Wagering Contest name, Entry Fee, Entry Limit, Start Time, Salaried Roster, Position Requirements, Scoring System, Slate, Payout Breakdown and any other Attributes. The Wagering Contest Rules are always to be read in conjunction with these terms and conditions.

(bb)  Wagering Contest Start Time means the time the Wagering Contest starts, usually displayed in a countdown format (e.g. “Live in 01:07:25” which means the Wagering Contest starts in 1 hour 7 minutes and 25 seconds).  All start times will be displayed as Australian Eastern Standard Time (unless otherwise notified).

(cc)  Wagering Contest Type means the type of Wagering Contest as described in clause 4 based on the applicable Wagering Contest Rules.

3. Entry into a Wagering Contest (placement of bets)

3.1 You must have a registered account in order to place a bet and enter a Wagering Contest.

3.2 You can select the Wagering Contest You wish to enter from the Lobby. The Lobby includes a list of upcoming Wagering Contests together with the key Wagering Contest Rules which may make up the Wagering Contest Type information, including the Sport, Prize Pool, Wagering Contest Name, Entry Fee, Entry Limit and Wagering Contest Start Time.

3.3 If You click on the Wagering Contest Name the remaining Wagering Contest Rules are displayed.

3.4 If You click “Play” You will be taken to the entry page where you can select Your Lineup in accordance with the Wagering Contest Rules. This may include, for example, selecting Athletes in positions that meet the Position Requirements and with Salaries that do not exceed the Salaried Roster.

3.5 Once You have selected Your Lineup in accordance with the Wagering Contest Rules, You can enter the Wagering Contest by selecting “Submit Lineup” which will submit Your team and place Your bet.

3.6 When You select “Submit Lineup” your bet will be placed and You will be entered into the Wagering Contest.

3.7 Your bet amount is the equivalent to the Entry Fee for the Wagering Contest. The Payout Breakdown outlines the potential winnings your bet could return. The odds for a bet are outlined as the potential return you can receive from your bet.

3.8 When Your bet is accepted by Us, we accept Your bet as a counterparty in accordance with these Terms and Conditions.  When You place a bet by entering a Wagering Contest, You bet with us, not with other customers who use our service.  We accept all liability for paying out any winnings won by a User on a successful bet in accordance with the applicable Payout Breakdown.

3.9 The bet will be considered to have been accepted by Us when we confirm bet placement to You via the Website.

3.10 The Entry Fee for each Wagering Contest is pre-determined and non-negotiable. Subject to the Bonus Bet Rules, Players are required to pay the Entry Fee to enter a Wagering Contest.

3.11 You may make changes to your Lineup after You have entered the Wagering Contest up until the Wagering Contest Start Time. Once the Wagering Contest starts, You will not be able to make any changes to Your Lineup.

3.12 We will not permit You to cancel a bet once it has been accepted. Exceptions to this rule may be made at the discretion of Draftstars.

3.13 All bets You place will be considered to have been placed, received and processed in the Northern Territory.

3.14 You are accountable and are responsible for ensuring You are legally entitled to;

(a) apply for an Account with Us;

(b)  place a bet with Us and receive winnings from Us; and

(c) remit funds from Your bank account, credit or debit card, electronic wallet (i.e. PayPal) or other stored value method to Us.

3.15 We reserve the right to refuse any bet or part thereof at any time without giving You prior notice or reason. In particular, We may refuse a bet placed by You for reasons that include but are not limited to the following:

(a) We suspect that You are in breach of Our rules;

(b)  We suspect that You are under the legal age of 18 years;

(c) We suspect that You are betting on behalf of a person under the legal age of 18 years;

(d)  We suspect that You are in breach of any laws; or

(e)  We consider that You present a liability risk to our business that We have deemed is unacceptable at our absolute discretion.

3.16 We reserve the right to close, impose limits on or remove products from Your Account without providing reasons or notice. In the event that We close Your account, We will refund the balance of Your Account to You and honour any outstanding bets You made prior to Your Account being closed, except if we have closed Your Account because We suspect You have used Your Account to engage in fraud, in which case all of Your outstanding bets will be deemed void.

3.17 Information We publish on our Website is indicative information only, and whilst We will endeavour to provide true and accurate information, We take no responsibility for the accuracy and validity of information published on Our Website.

3.18 You must exercise Your own judgement when choosing whether to place a bet. You acknowledge that, in placing Your bet, You are not relying on any statements made by Us relating to the subject of the bet.

3.19 If We inadvertently accept a bet after the start time of a Wagering Contest, We reserve the right to cancel that bet.

4. Wagering Contest Types

4.1 There a number of different Wagering Contest Types that You can enter. Each Wagering Contest Type has different characteristics based on the Wagering Contest Rules of that particular Wagering Contest Type. The list of Wagering Contest Types available are as follows:

(a) Standard Contests

These Wagering Contests require a specified number of Entrants to run. If the Wagering Contest doesn’t completely fill by the Wagering Contest Start Time, we’ll cancel the Wagering Contest and refund all Entry Fees to the users’ accounts.

(b)  Autofit Contest

Wagering Contests marked “autofit” will run even if the Wagering Contest doesn’t fill with the required number of Players however the Prize Pool and corresponding Payout Breakdown will be adjusted at the Wagering Contest Start Time to reflect the number of Players who have actually entered the Wagering Contest.

(c)  Guaranteed Contests

We guarantee the Prize Pool for these featured Wagering Contests. We’ll start the Wagering Contest on-schedule and pay it out in full regardless of the number of entrants.

(d) Live Draft

These Wagering Contests require a specified number of entrants to run. Once enough entrants register, the draft will begin. Players are assigned a draft pick and select their Athletes in sequential order until all teams are filled. Athletes can only be chosen once per Live Draft, so you cannot pick the same Athlete(s) as other entrants.

(e)  Turbo

Turbo contests require selection of a single player from each of a set of tiers, pre-determined by Draftstars.

(f)  Double Up

Double Up contests pay double the entry fee to the winners, normally set at around 45% of the Players in the Wagering Contest.

(g)  Modified Salary Cap

Modified Salary Cap contests offer different starting salary amounts for selecting Line-ups. The salary cap for these Wagering Contests may be more or less than the cap in a standard Draftstars contests.

(h)  Tournament

A Tournament is run over a limited number of rounds, the last of which is a Final Round. Each round consists of one or more Contests whose Prize(s) includes a limited number of entries into a Contest in the next round of the Tournament. The Final Round of the Tournament will be run as a Guaranteed Contest.

(i)  Target

Target Wagering Contests specify a Target Score in the Game Rules. Every Player whose Lineup reaches the Target Score will share equally in the Prize Pool. For example, if the Target Score is 350, the Prize Pool is $1,000 and two Players score over 350 Points, they will each receive $500. In the event that no Player reaches the Target Score no Player will receive a Payout and the whole Prize Pool for that Target Wagering Contest will be added to the Prize Pool for the next Target Wagering Contest (“Jackpot Prize Pool”). This process will continue until the Jackpot Prize Pool is won.


RAPIDFIRE is a game where a Player selects one of the athletes listed in each of five tiers, with the aim of selecting the athlete that will score the most fantasy points that day. Based on how many tiers they select correctly out of the 5 tiers, the player may win a prize.

5. Wagering Contest Rules

5.1 Each Wagering Contest will run in accordance with these terms and conditions and the applicable Wagering Contest Rules.

5.2 You will not be able to enter the Wagering Contest unless you have selected your Lineup and placed Your bet in accordance with the Wagering Contest Rules.

5.3 A Player may be able to enter more than one Entry into a single Wagering Contest by placing multiple bets. Any restrictions on entries will be included in the Wagering Contest Rules.

5.4 Draftstars may place restrictions on the Wagering Contests You can enter based on at its discretion based on criteria such as the number of Wagering Contests previously played and the total value of Payouts You have received. Draftstars will use best endeavours to communicate such restrictions to You via email or by listing restrictions in the Wagering Contest Rules.

5.5 Except in the case of Contests marked as “Autofit”, If a Wagering Contest doesn’t fill with the required number of Players, We will cancel the Wagering Contest and all Entry Fees will be refunded to each Player’s account. Guaranteed and Autofit Contests are exempt and will always go ahead.

5.6 Autofit Contests will have the payouts adjusted to reflect the number of entrants relative to the maximum entrants for that contest. This will be done by applying the ratio of entrants to maximum entrants to each prize, then adding all prizes less than the buy in to the first place prize to derive the final list of prizes.

5.7 If any Match within a Slate is cancelled, postponed or abandoned then all Wagering Contests in which that Match formed part of the Slate will be cancelled, all bets voided and all amounts bet returned to the Players. In such circumstances, no Payouts will be paid for these Wagering Contests.

5.8 For the avoidance of doubt, in the case of Cricket Wagering Contests, provided a Match has progressed enough for the governing body to declare a result for the Match it will form part of the Wagering Contest as per normal. Only if a match is cancelled or abandoned and no result determined will 5.7 apply.

5.9 In the case of Wagering Contests marked as “NRL Game Time Insurance”, where a Player starts a match as one of the official starting 13 players, and at the conclusion of the match that Player has had less than 30 minutes of total game time according to the official stats provider, any entries in the contest that do not finish in a position high enough to receive a payout, and that have selected that Player in their Lineup, will have their entry fee refunded.

6. Scoring

6.1 During a Wagering Contest Your Entry will earn Points as the Athletes in your Lineup compete in their Match in accordance with the Scoring System for the applicable Sport.

6.2 The statistics used to calculate the Points will be those supplied by Our official statistics providers for each Sport, being Third Party Suppliers. No statistics other than those supplied by our official statistics providers will be used or considered by Draftstars for any Wagering Contest.

6.3 Our official statistics providers are as follows:

(a) AFL: Champion Data

(b) Cricket: Fox Sports Australia Pty Ltd

(c) NRL: Prozone Sports Australia Pty Ltd

(d) NBA: SportRadar.

(e) NFL: SportRadar.

(f) MLB: SportRadar.

(g) Golf: SportRadar.

(h) Tennis: SportRadar.

6.4 Draftstars reserves the right to change its official statistics providers at any time by amending the Terms and Conditions.  It is Your responsibility to review the Terms and Conditions to understand the official statistics providers.  Should a significant change such as this occur, Draftstars will use reasonable endeavours to bring this change to customers’ attention (via email communication).

6.5 Whilst the Website will show “close to live” updates on Points scored by Athletes, the final result of a Wagering Contest is not determined until the finalised statistics are confirmed by our official statistic providers and final Points are calculated.

6.6 Athletes that do not play in a Match will not earn any Points. Players who select an Athlete who does not play will receive zero Points for that Athlete. Players are solely responsible for determining whether they believe an Athlete will or will not play in a Match.

6.7 Each Player competing in a Wagering Contest will be ranked in accordance with the total Points scored by the Athletes in their Lineup from highest to lowest.

Cricket specific scoring rules

6.8 The following rules apply to Cricket Wagering Contests:

(a) No Points are awarded during Super Overs (tie break over at the end of a tied Match);

(b) Substitute fieldsmen do not score Points; and

(c )If an Athlete is substituted into the game under the Big Bash League’s Concussion Rule, they will be eligible to earn Points.

7. Payouts

7.1 Draftstars accepts all liability for paying out any winnings won by a User on a successful bet in accordance with the applicable Payout Breakdown.

7.2 At the conclusion of a Wagering Contest, each Entry will be ranked according to total Points scored. The final finishing positions will determine which Players are to receive the Payouts (on their bets placed) in accordance with the Payout Breakdown for the Wagering Contest.

7.3 A Payout is provided to successful Players in a Wagering Contest and represents the payment to a Player of winnings on a successful bet placed.

7.4 In the event of a dead-heat between two or more Entries, the combined Payout for the finishing positions which the dead-heated Entries cover will be combined and divided equally amongst those Entries who have dead-heated. Below are two examples:

(a) If 3 Entries dead heat for first place, the Payouts for first, second and third will be combined and shared equally between those Entries. If applicable, the next ranked Entry will receive the Payout for fourth place.

(b)  If a Wagering Contest has a Payout for the top 5 ranked Entries and 4 Entries dead-heat for fifth place, the Payout for fifth place will be shared equally between those 4 Entries.

7.5 Payouts will be credited to winning Players’ accounts when all final statistics are received and Points calculations finalised, per data utilized by Us from Third Party Suppliers. The scoring results of a Contest will not be changed regardless of any official statistics or scoring adjustments made by the leagues at later times or dates, except in Draftstars sole discretion.

7.6. In Draftstars RAPIDFIRE 3 and RAPIDFIRE 5 contests, where there is a tie for the highest score of players in a tier, the tier is considered a tied tier and a revised payout for entries placed may apply, depending on the number of points scored from other tiers:

(a) Where one of the players in a tier plays no game time in a match (either due to non-selection, being an unused substitute, or the match being cancelled), then the result of that tier will be considered a tied tier for calculating payouts.

(b) Payouts for contests with tied tiers will be adjusted as per the tables below for RAPIDFIRE 3 and RAPIDFIRE 5 respectively. Standard payouts will apply for scores not included in these tables.

8. Disqualification and Cancellation

8.1 Draftstars reserves the right to cancel or alter the terms of any Wagering Contests in Our sole discretion and without any restrictions.

8.2 Draftstars, in its sole discretion, may disqualify You from a Wagering Contest, refuse to award You with any winnings, require the return of winnings paid to You, or suspend or terminate Your account if You engage in conduct we deem, in our sole discretion, to be improper, unfair or otherwise adverse to the operation of the Website or in any way detrimental to other Users.

8.3 For the purpose of this clause, improper conduct includes, but is not limited to:

(a) falsifying personal information required to use the Website or to verify an account or to verify a credit card ;

(b)  violating any of these rules, placing bets through unauthorized methods such as automated scripts or other automated means;

(c) tampering with the administration of the Website or trying to in any way tamper with the computer programs associated with the Website;

(d)  obtaining other Users’ information and spamming other Users;

(e)  abusing the Website in any way;

(f)  otherwise violating any of the terms and conditions associated with the Website and Draftstars; and/or

(g) alter or manipulate the geolocation protocols to represent that you are accessing the Websites from a location other than your true and correct physical location, or the use of tools such as proxies.

8.4 The forfeiture and/or return of any Payouts or winnings shall in no way prevent Draftstars from pursuing criminal or civil proceedings in connection with such any conduct.

8.5 If for any reason the Website is not running as intended (e.g., if the Website becomes corrupted or does not allow the proper usage and processing of bets in accordance with the terms and conditions, or if infection by a computer virus, bugs, tampering, unauthorized intervention, actions by users, fraud, technical failures, or any other causes of any kind, in the sole opinion of Draftstars corrupts or affects the administration, security, fairness, integrity or proper conduct of the Website), Draftstars reserves the right, in its sole discretion, to disqualify any individual implicated in or relating to the cause and/or to cancel, terminate, extend, modify or suspend use of the Website. If such cancellation, termination, modification or suspension occurs, notification may be posted on the Website.

8.6 Employees of Draftstars Pty Ltd and CrownBet Pty Ltd (Prohibited Employees) are ineligible to participate in any Contest where there is an Entry-Fee and/or Payout. Should a Prohibited Employee enter such Contest they will be disqualified from the Contest, removed from the final finishing position and will not receive any Payout. In such circumstance, all other Players will move up the final finishing position as if the Prohibited Employee did not enter the Contest.

9. Conduct

9.1 As a condition of use, you promise not to use the Website for any purpose that is unlawful or prohibited by these terms and conditions, or any other purpose not reasonably intended by Draftstars. By way of example, and not as a limitation, you agree not to:

(a) abuse, harass, impersonate, intimidate or threaten other Draftstars users;

(b)  post or transmit, or cause to be posted or transmitted, any Content that are infringing, libelous, defamatory, abusive, offensive, obscene, pornographic or otherwise violates any law or right of any third party;

(c) use the Website for any unauthorized purpose, or in violation of any applicable law, including intellectual property laws;

(d)  post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any Draftstars user;

(e)  create or submit unwanted email (“Spam”) to any other Draftstars users;

(f)  infringe upon the intellectual property rights of Draftstars, its users, or any third party;

(g) submit comments linking to affiliate programs, multi-level marketing schemes, sites repurposing existing stories or off-topic content;

(h)  post, email, transmit, upload, or otherwise make available any material that contains software viruses or any other computer code, files or programs designed or functioning to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;

(i) use any robot, spider, scraper, sniping software or other automated means to access the Service for any purpose (except for RSS feed access) without our express written permission. Additionally, you agree that you will not: (1) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (2) interfere or attempt to interfere with the proper working of the Service or any activities conducted on the Service; or (3) bypass any measures we may use to prevent or restrict access to the Service;

(j)  use artificial means, including creating multiple user accounts, to inflate your position and standing with the Draftstars leader boards and community;

(k) advertise to, or solicit, any user to buy or sell any products or Service, or use any information obtained from the Service in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent;

(l) sell or otherwise transfer your profile;

(m)  attempt to influence the play in any sports event that is the subject of a competition on Draftstars in which you are involved or in which you have a direct or indirect interest.

9.2 Violation of our Terms and Conditions may result in the removal of your Content from the Website and/or the cancelling of your account. You acknowledge and agree that Draftstars may remove any User Content and terminate any Draftstars account at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such User Content). To report violations of our terms and conditions, please contact us.

10. Requested Records

10.1 Once we have opened an Account for You and You have made a bet, We reserve the right to provide an Australian governing sporting body with information about You when that information is requested from Us by that Australian governing sporting body in the course of a legitimate enquiry. Such information that We may provide to an Australian governing sporting body includes, but is not limited to:

(a) Records in Our possession or control relating to Your betting transactions; and

(b)  Your contact, personal and financial details.

11. Your Warranties

11.1 By applying for or using an Account with Us and/or by using the Website/Application you warrant and agree that you:

(a) are at least 18 years of age and are above the legal age for gambling in your Jurisdiction;

(b)  are legally capable of entering into binding contracts;

(c) are legally able to visit, use or otherwise participate through the Website in your Jurisdiction;

(d)  will not allow any third party (in particular, but without limitation, any minor/s) to, directly or indirectly, access or use your Account including, without limitation, making deposits into or withdrawals from your Account or placing bets through your Account;

(e)  will not use your Account on behalf of or for the benefit of another person.

(f)  have provided Us with personal details that are valid, accurate, and complete in each and every respect and that you will advise us immediately via e-mail should any such details change;

(g) are the true and lawful owner of the monies that you wager with us and that you are duly and properly authorised to utilise such monies for the aforementioned purposes.

(h)  will not deposit nor wager any monies with us that are derived in any manner whatsoever from illegal activities;

(i) will pay all monies owed to us, and in respect of payment shall not charge-back, or deny or reverse or countermand any such payments;

(j)  are wholly responsible for the secrecy of your Account username and password.

(k) will make every effort to prevent the use of your Account by any third party; and

(l) will be wholly responsible for any transactions entered into via your Account.

11.2 In the event of any of the warranties set out in clause proving to be false, Draftstars reserves the right to act as follows : Your bet will be forfeited and we will not be obliged to pay any winnings which might otherwise have been payable to you. We may also report the matter to the police and any appropriate regulatory authority.

11.3 Existing customers are responsible for ensuring the accuracy of their personal information, this includes, but is not limited to key details such as: telephone number(s), email address, and (current) bank account and credit card information. If any of these details are incorrect, or out of date, customers must notify and update Draftstars at their earliest convenience.

11.4 Draftstars reserves the right to suspend accounts that have invalid, or inaccurate information.

12. Errors

12.1 We will endeavour to ensure that We do not make errors when accepting bets. However, we reserve the right to cancel any bets where a palpable error has occurred. If We cancel a bet because a palpable error has occurred, We will endeavour to contact You.

12.2 If You are allowed to erroneously place a bet after a Wagering Contest has commenced, You agree that We may retrospectively void the bet and We will be entitled to repayment from You for any winnings in relation to such a bet that has been withdrawn from Your Account. If this occurs, You agree that We will issue an invoice in respect of the winnings paid in error, and that the invoice shall be evidence that the amount is due and payable immediately.

12.3 If You have received funds from Us in error and have used those funds to place a bet on a Wagering Contest that has not yet commenced, We reserve the right to cancel that bet at any time without notice. If You have placed such bets to an amount that is greater than the total You owe to Us, We will contact You to mutually agree the bet cancellation arrangements prior to the commencement of the Wagering Contest. If we cannot contact You prior to the commencement of the Wagering Contest, We will at Our discretion make amendments to the bet or cancel the bet in order to recover the funds that have been paid in error.

13. Indemnity

You agree to release and to indemnify, defend and hold harmless Draftstars and its parents, subsidiaries, agencies, contractors, subcontractors, suppliers, licensors and partners, as well as the officers, directors, employees, shareholders and representatives of any of the foregoing entities, from and against any and all losses, liabilities, expenses, damages, costs (including attorneys’ fees and court costs) claims or actions of any kind whatsoever arising or resulting from your use of the Service, your violation of these Terms of Use, your receipt, ownership, use or misuse of any prize, and any of your acts or omissions that implicate publicity rights, defamation or invasion of privacy. Draftstars reserves the right, at its own expense, to assume exclusive defence and control of any matter otherwise subject to indemnification by you and, in such case, you agree to cooperate with Draftstars in the defence of such matter.

14. Warranty

You expressly understand and agree that your use of the Website is at your sole risk. The Website and the services provided on it are provided on an “AS IS” and “as available” basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement. You acknowledge that neither Draftstars nor its employees, agents, suppliers, partners, licensors, or contractors or subcontractors have any control over, and no duty to take any action regarding: which users gain access to or use the Website; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release Draftstars from all liability for you having acquired or not acquired Content through the Service. The Service may contain, or direct you to other websites containing information that some people may find offensive or inappropriate. Draftstars makes no representations concerning any Content contained in or accessed through the Service, and Draftstars will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Service.

15. Limitation of liability

You acknowledge and agree that You assume full responsibility for Your use of the Website.  You acknowledge and agree that any information you send or receive during your use of the Website may not be secure and may be intercepted or later acquired by unauthorized parties. You acknowledge and agree that your use of the site and service is at your own risk. You understand and agree that, to the fullest extent permitted by applicable law, neither Draftstars nor its suppliers, contractors, subcontractors, partners, agents, or licensors will be liable to you for any direct, indirect, incidental, special, consequential, punitive, exemplary or other damages of any kind, including without limitation damages for loss of profits, goodwill, use, data or other tangible or intangible losses or any other damages based on contract, tort, strict liability or any other theory (even if Draftstars had been advised of the possibility of such damages), resulting from the Website or services provided in connection with the Website;

(a) the use or the inability to use the Website;

(b)  unauthorized access to or alteration of your transmissions or data;

(c) statements or conduct of any third party on the Website;

(d)  any actions we take or fail to take as a result of communications you send to us;

(e)  any incorrect, illegible, misdirected, stolen, invalid or inaccurate entry information;

(f)  human errors;

(g) technical malfunctions;

(h)  failures, including public utility or telephone outages;

(i) omissions, interruptions, latency, deletions or defects of any device or network, providers, or software (including, but not limited to, those that do not permit an entrant to participate in the service);

(j)  any injury or damage to computer equipment;

(k) inability to fully access the site or service or any other website;

(l) theft, tampering, destruction, or unauthorized access to, or alteration of, entries, images or other content of any kind;

(m)  data that is processed late or incorrectly or is incomplete or lost;

(n)  typographical, printing or other errors, or any combination thereof; or any other matter relating to the site or service.

Notwithstanding anything to the contrary contained herein, Draftstars’ and its suppliers’, contractors’, subcontractors’, licensors’, and partners’ liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Draftstars for general use of the Website during the term of your registration for the Website, not including any bets resulted prior to the circumstances giving rise to the claim.

16. Responsible Gambling

16.1 In operating Our Website, We will provide pre-commitment facilities to help You control the amount You spend on bets whereby you can limit the amount of money deposited, with option to set daily, weekly, or monthly deposit limits through the My Account section of our website and app, or by contacting Our customer service team for assistance.

16.2 You may lower a deposit limit immediately at any time by using the form available in the My Account section of the Draftstars website or App, or contacting Our customer service team.

16.3 Any request to remove or increase a deposit limit will not be effected until 7 days after the request.

16.4 We will also provide You a voluntary self-exclusion facility to assist You to stop gambling if You feel that you have developed a gambling problem. Self-exclusions take effect immediately and cannot be undone. To self-exclude yourself, please contact Our customer service team or complete the Self Exclusion Form on the NT Government’s website.

16.5 At Your request, We will prevent you from using your Account, either for as short a period of time as one (1) day, or a longer period of time for instance a week or a month or six (6) months, as well as indefinitely (permanently).

16.6 During the self-exclusion period requested:

(a) Your pending bets will stand;

(b)  winnings from bonus bets which have not been turned over will be void;

(c) bonus bets will be void;

(d)  the balance will be withdrawn when requesting self-exclusion for thirty (30) days or more;

(e)  You will need to contact Our customer service for withdrawal assistance for self-exclusion periods of less than thirty (30) days;

(f)  You will not receive marketing emails;

(g) You will not be able to deposit;

(h)  You will not be able to login to Our Websites.

16.7 Whilst you are self-excluded, We may retain such personal information about You as is necessary and for as long as is necessary to implement the self-exclusion facility as effectively as possible, including your name, address and payment details.

16.8 If You are a self-excluded customer:

(a) You must not apply for an Account or place any bets with Us using your account or otherwise;

(b)  You are fully liable for your actions, and for all activity and bets You place; and

(c) Subject to these General Rules, if We consider that You have deliberately circumvented our controls (e.g. by successfully applying for a duplicate Account) and placed bets while you are a self-excluded customer: (i) open/pending bets will be voided and the original stake returned to your Account; (ii) resulted bets will stand; and (iii) the balance of your Account (minus any credit owed) will be returned to you.

17. Client Verification

In line with all Australian Financial Institutions under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006, all Account holders are required to provide Draftstars with adequate identification for the purposes of complying with the Act. The provisions of the Act provide for Australian Government standards of identification for proof of name, age and residential address.

18. Client Verification Rules

18.1 All bookmaker client accounts in Australia are required to undergo customer identification, as stipulated by the Federal Government of Australia. We have endeavoured to make this process as simple and hassle free as possible for you.

18.2 All Accounts must be verified by Us prior to any withdrawal and processed within forty-five (45) days of Us opening the Account.

18.3 Our Verification rules are:

(a) Client ‘identification information (‘ID’) means Your name, residential address (‘address’) and date of birth, as provided to Us upon applying for Your Account. If You do not provide full details up front, We may suspend Your Account without notice, pending an investigation by Us.

(b)  Before You place Your first bet or deposit funds for the first time after We open an Account for You, You accept that We will supply Your ID to Veda or other third parties for the purpose of ID Verification. The verification process may involve checking your ID against third party databases and credit headers. We will not pass Your personal financial information to Veda or any other third party ID verification provider. We may also use other public information services to confirm Your identity.

(c) We also require proof of Your current address. If Your address is not on the front or back of the photographic identification You provide to Us, You must provide proof of current address acceptable to Us. Acceptable proof of current address in such circumstances may include a certified copy of one or more of (a) a rates notice; (b) a utility bill; (c) a statement from a financial institution; (d) home insurance Papers: (e) Motor Insurance papers; and (f) Private Health Insurance Statement. Such a document provided as proof of current address must be dated no more than 3 months prior to the date that You provide it to us.

19. Payment Verification

19.1 If You use any type of credit or debit card to fund Your Account, We may require a copy of the front of that card, which You must send to Us for Our approval on Our request. We reserve the right to refuse to accept a credit card at Our absolute discretion including but not limited to in circumstances where the credit card is dishonoured. The Credit or debit card You use to fund Your Account must match Your Account details. If You use a credit card with a name on it that is not the name that is registered with Us for the Account used in relation to a transaction, the transaction will be voided and the associated Account may be suspended until proof of consent is provided by the third party cardholder. We reserve the right to request a copy of the front of the credit or debit card registered on Your Account at any time. However, we do not guarantee that Your Account will be activated or re-activated even if we receive a copy of Your credit or debit card .

19.2 We will not allow a third party bank account holder or credit or debit card holder to transact on an Account that is not been registered in his or her name. You must use Your own bank account or joint deposit and withdrawal methods. We reserve the right to suspend any Accounts, without notice, with third party payment details and will request confirmation of permitted use from that third party prior to re-opening the applicable Account and allowing further transactions.

19.3 If You use any of our Deposit options you accept that We may request a bank statement to verify where funds have originated from prior to any withdrawal being approved. You also accept that We may decide to return these funds at Our discretion and void bets should We deem that the transaction was not authorised.

20. Dishonoured Payments

20.1 You agree that You will not effect a charge-back or other cancellation of a deposit relating to Your Account without Our consent. If You do effect a charge-back or other cancellation of a deposit relating to Your Account or if the payment is dishonoured or not received by Us into Our nominated account for any reason (Dishonoured Payment) then You agree to indemnify us for any costs, claims, damages and expenses relating to or arising in connection with the Dishonoured Payment, including any expense incurred by us in recovering such amounts.

20.2 When You make a payment to Us by using any of our deposit options, that payment will be deemed to be a credit advance made to You by Us until We have received full receipt of that payment in Our nominated account. Where any payment made by You constitutes a Dishonoured Payment and You have used those monies that We have advanced into Your Account to place any bet, then the Credit Terms will apply to that Dishonoured Payment.

20.3 If You dispute a financial transaction on Your Account relating to a third party, We may temporarily suspend Your Account, without notice, pending an investigation by us relating to the transaction, and debit your account for the chargeback amount. If we incur any loss as a result of that investigation, we reserve our right to recover such losses from You.

21. Insolvency

In accordance with Draftstars’ licence conditions, Draftstars maintains a separate bank account, the contents of which match every dollar of clients funds as a safeguard of client funds in the event of insolvency. To ensure compliance this is regularly monitored by the NTRC.

22. Fraud

22.1 We reserve the right to withhold deposited funds and winnings from resulted bets if we determine that a credit or debit card has been misused or used fraudulently. Any matters of inappropriate or fraudulent use of any credit or debit card will be reported to the appropriate authorities. In the instance that We deem fraud has occurred, Your Account may also be closed.

22.2 We use third party technologies to track and store technical information, including geolocation. You accept that this data may be used to reach decisions on investigations where Accounts have not been operated in good faith, including but not limited to Account takeover, bonus or betting abuse, multiple Account operations, payment method abuse etc.

22.3 We reserve the right to close Your Account and void any or all bets made by You if You attempt to defraud Us.

22.4 We may review Your Account to monitor any activity that We consider suspicious. If We deem Your activity suspicious, We reserve the right to suspend Your Account without notice pending a full investigation.

22.5 We may request that You provide Us with acceptable photographic identification and proof of a Your current address at any time to ensure that all information You supplied to Us is up to date. We may request and require You to obtain official certification of Your ID documents by a permitted certifier.

22.6 If You deliberately alter any ID or any other details for any purpose associated with applying for an Account or transacting on an Account, We reserve the right to suspend that Account and close it without prior notification to You.

22.7 If You use any of Our deposit options you accept that We may request a bank statement to verify where funds have originated from prior to any withdrawal being approved. You also accept that Draftstars may decide to return these funds at Our discretion and void bets should We deem that the transaction was not authorised.

22.8 If Draftstars determines that there is not enough information to prove the owner of a particular payment option, we reserve the right to request documentation as proof of ownership prior to making any decision.

23. Third Parties

23.1 If we consider that a third party is placing bets on Your Account, We may void any pending bets and close the Account.

23.2 If We discover that You reside in a Restricted Jurisdiction and have successfully applied for an Account, we may in Our absolute discretion close the Account and request proof of payment method, personal identification and bank account information before We permit You to withdraw the original funds. Your winnings may be forfeited if You successfully apply for an Account contrary to this section.

24. Payment Terms

24.1 Payouts will be credited to Your Account following confirmation of the final result for a Wagering Contest. If funds are credited to Your Account in error for any reason, it is Your responsibility to notify Us of the error without delay and to return any funds credited to You in error. Any such amounts that We wrongfully credit to You are immediately due and payable by You to Us regardless as to whether any funds have been paid to You following the error or You have made bets that negatively affect Your Account Balance.

24.2 Draftstars requires that any deposits into a Member’s Account be turned over at least once or ‘bet through’ prior to requesting a withdrawal from their Account.

25. Underage Persons

25.1 Our betting services are designed to appeal to and be used by adults only. We actively discourage children (persons who have not attained the age of 18 years) attempting to bet on our Website.

25.2 If children have access to a computer/smart phone/tablet You use to access Our Website, We encourage you to download and install a popular child-protection software package, such as Net Nanny or Cyber Patrol. Such software is an effective protection to assist You to prevent children from being able to access our Website.

26. Dispute Resolution

26.1 These General Rules are governed by and construed in accordance with the laws of the NT and You agree to submit to the non-exclusive jurisdiction of NT courts in relation to any dispute arising out of or relating to these General Rules or the provision by Us of any goods or services to You (‘Dispute’).

26.2 If any Dispute between You and Us cannot be resolved between You and Us, that Dispute must be referred by You to a representative of the NTRC (Northern Territory Racing Commission) via email at https://nt.gov.au/industry/gambling/complain-about-a-bookmaker/gambling-dispute-form or post addressed to Gambling Disputes, GPO Box 1154, Darwin, Northern Territory, for final determination. A Dispute must be lodged with the NTRC by You within fourteen (14) days of the Dispute arising. The decision of the NTRC is final and binding on You and Us. Nothing in these General Rules precludes a party from seeking urgent interlocutory relief from a court if such relief is reasonably required.

27. Inactive Accounts

27.1 If You do not access Your Account by logging on to Your Account using Your Account username and password and either (i) making a deposit, or (ii) placing a bet, for any consecutive period of 2 years, then after those 2 years Your Account will be deemed ‘Inactive’.

27.2 Once Your Account has been deemed Inactive We may suspend Your Account and We will be entitled to charge You an administrative fee (the ‘Inactive Account Fee’). We may deduct an of up to $5.00 as an Inactive Account Fee from Your Account Balance on the day that your account is deemed inactive and then every one (1) month thereafter. If Your Account Balance is zero (or becomes zero) We will not charge any further Inactive Account Fees.

27.3 Once your Account is deemed inactive, We will also remove any Bonus Bets and Draftstars Rewards Points from Your Account.

27.4 If Your Account is inactive and You attempt to log back in, Draftstars will lift the suspension on Your Account. When a suspension is lifted, We will refund all the Inactive Account Fees previously charged to Your Account. We will stop deducting the Inactive Account Fee from Your Account balance.

27.5 Draftstars employees and affiliated companies and agents are not eligible to participate for real money on Draftstars Websites.

Bonus Bet Rules

28. General

28.1 These are the Draftstars Bonus Bet Rules (“Bonus Bet Rules”) of Draftstars Pty Limited (ACN 609 405 816) (Draftstars, We, Us), a company incorporated in Australia under the Corporations Act 2001 (Cth). Draftstars is licensed in the Northern Territory (‘NT’), Australia by the NT Racing Commission (‘NTRC’) to accept bets and wagers (together ‘bets’) by electronic transmission, twenty-four (24) hours per day.

28.2 These Bonus Bet Rules shall be read in conjunction with the Draftstars Website Terms and Conditions located at www.Draftstars.com.au or via our mobile phone or tablet applications (together ‘the Website’), which applies to all Draftstars Users. You and Your means a User using, browsing or otherwise accessing any content or data on the Website to enter a Wagering Contest. You acknowledge and agree that, by opening an Account (as defined in the Website Terms and Conditions of use and/or placing bets, You agree to be bound by these Bonus Bet Rules

28.3 We reserve the right to change, amend or add to these Bonus Bet Rules at our discretion, and will publish such changes on our Website. You agree that any changes, amendments or additions published on our Website will be taken to be effective immediately. It is Your responsibility to ensure that You are aware of the current Bonus Bet Rules.


29. Bonus Bet Promotional Period

29.1 Bonus Bet promotions are available from time to time and details will be included in the specific promotion terms or rules.

30. Eligibility

30.1 Only members of Draftstars are eligible to participate in Bonus Bet promotions.

30.2 Bonus Bet promotions are those offers issued to Members via an email promotion or by any other means advertised on the Website or those advertised on approved affiliated websites.

30.3 A Bonus Bet promotion entitles a Member to place a wager by way of free entry into a Wagering Contest and for that Member to receive cash winnings derived from that Bonus Bet which, if successful, is paid into the Member’s account balance.

30.4 Unless otherwise stated, a Bonus Bet credited into a Member’s account is valid for thirty (30) days from the time it is credited into a Member’s account. If the Bonus Bet is not used within the thirty (30) day period it will expire and become void.

30.5 Bonus Bets are restricted to one single bet, being one Entry into a Wagering Contest.

30.6 Draftstars can determine the value of the Bonus Bet, what Wagering Contest(s) the Bonus Bet can be used to enter by the Member and any other applicable restrictions at its discretion, for example, a particular Sport (e.g. AFL only), through a specified platform (e.g. via the “App” only), or for a specified Wagering Contest type (e.g. H2H only). Such details will be included in the Bonus Bet’s terms and conditions.

30.7 The terms and conditions of a Bonus Bet will be communicated to the Member:

(a) in the offer; and/or

(b)  by electronic communication; and/o

(c) on the Websites.

30.8 Management and employees of Draftstars and affiliated companies and agents are not eligible to participate in Bonus Bet promotions.

31. Bonus Bet Information

31.1 Bonus Bets can be used to enter Wagering Contests up to a specified value subject to unique Bonus Bet’s terms and conditions as published in an email to Members or on the Website.

31.2 To use the Bonus Bet, Members must login to the Website and select the Wagering Contest they wish to enter. If a Member can use a Bonus Bet to enter the Wagering Contest, the Member will be prompted after they select “Submit Lineup” to either use the Bonus Bet to enter or pay the Entry Fee.

31.3 A Member who enters a Wagering Contest using a Bonus Bet is eligible for the Payout outlined in the Wagering Contest Rules for that Wagering Contest as if they had paid the Entry Fee to enter.

31.4 Any winnings derived from a Wagering Contest entered by a Member using a Bonus Bet will be credited to the Member’s account balance.

31.5 There are no turnover requirements for any winnings received by a Member from a Wagering Contest they have entered using a Bonus Bet.

32. Bonus Bet General Terms

32.1 Bonus Bet promotion offers are intended for bona fide Members who comply with the Website, General and Bonus Bet terms and conditions, act without fraud and place bets with Draftstars for the purpose of recreation and entertainment.

32.2 Professional gamblers or people who are considered by Draftstars to be attempting to abuse or those who have frequently abused Bonus Bet promotions to manipulate financial outcomes may have their right to participate in Bonus Bet promotions and offers revoked.

32.3 Draftstars reserves the right to cancel or change a Bonus Bet promotion at any time throughout the Promotion Period without cause to provide specific notice.

32.4 Decisions made by the management of Draftstars in respect of Bonus Bet offers and promotions are final and binding.

32.5 The promoter for all Bonus Bet promotions and offers is Draftstars.
